Off-Road Vehicle Safety

RCMP continues to receive reports of aggressive and illegal off-road vehicle operation within Northern Peninsula communities. As a result, residents can expect to see increased enforcement efforts.

The Law:

Helmet Use: Properly fitted and fastened, approved helmets are mandatory for each occupant of an off-road vehicle, which includes side-by-sides, dirt bikes, quads and snowmobiles. Those in violation will be ticketed. Fine $250 – $1000.

Operation on a roadway:

  • It is illegal to operate any off-road vehicle on a roadway at any age, unless a by-law is in place that otherwise permits.
  • A person who holds a licence or is being properly supervised by a licenced driver may cross a roadway if they have a minimum of 150 meters of visibility in both directions.
  • Operations along the shoulder of the roadway to access a trail, provided the distance is less than 1 km and the speed does not exceed 20 km/h, is permitted. Operators must yield to motor vehicle traffic.

Age of operation – What parents need to know

  • Children under the age of 16 years must be supervised (see and be seen by the supervisor) at all times, by a licenced driver at least 18 years old, and must not exceed the manufacturers recommendations with respect to the age of operation and weight for the specific off-road vehicle.
  • Penalties: A ticket (fine) to the supervisor and/or owner and seizure and impoundment of the off-road vehicle with associated fees.
  • Fines: Supervisor – $100 – $400, Owner – $500 – $1,000
